BIAN’s system automatically records information, namely usage data, during the visit to BIAN’s offering. The IP address is saved only for the period of use and will be deleted or made anonymous afterwards.

BIAN gathers personal data to the extent that they are necessary for the establishment, substantive structure or modification of the contractual relationship between BIAN and the respective user concerning the use of the offering of BIAN or if the user has communicated them in the course of contacting BIAN. With complete execution of the contract the data are being blocked for further use and shall be deleted after expiration of storing periods according to tax and trade law.

BIAN uses personal data of users to the extent necessary for the establishment, performance or ending of the contractual relationship with the respective users. This is the case if, among other things, users wish to utilize the products and services of BIAN via the BIAN offering.
Both the simple transmission of specific personal data by the user (for example, in specific forms for product or service orders), as well as the registration of a user for the use of the BIAN service, might be necessary by way of electronic or other communication as part of the use of the BIAN offering. 4.1.1 Payment processing
BIAN is entitled to make user payment data available to an assigned service provider. BIAN cooperates with PAYONE GmbH from Germany. Insofar as users provide credit card data to BIAN for the payment in the real time process, the credit card numbers are used exclusively for the payment processing and no other purposes. BIAN can use the services of a provider for fraud management of the payment process in order to create an increased degree of security against fraud for the benefit of the users and BIAN and to promote the protection of financial information.
We use the list provider MailChimp to send our newsletters. MailChimp is a product of The Rocket Science Group, LLC, 512 Means Street, Ste 404 Atlanta, GA 30318. When you register for our Newsletter, the data you provide in the registration will be transferred to MailChimp and stored there. MailChimp participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework.
MailChimp provides extensive analysis on how the newsletters are opened and used. These analyses are group-related and are not used by us for individual analysis. MailChimp additionally uses the analysis tool “Google Analytics” and includes it in the Newsletter where appropriate. BIAN uses session cookies when users log in to the BIAN offering. In this case, BIAN’s web server automatically sends a session cookie to the user’s browser. Session cookies are used within the framework of authentication of users. Authorized users are logged when they register for the BIAN service. A session cookie is set for the connection, to indicate that the user has been authenticated. This session cookie contains random data that the server uses to authenticate the browser queries to the server within that session. Cookies contain information about which services within the BIAN service the users have been used, in which country the computer of the user is located and in which language the BIAN service has been used. Additionally, the cookie contains the user ID, a number which is assigned to each user by BIAN. In addition, the session cookie contains a value, by means of which the BIAN software can determine which page is supposed to be displayed when the user clicks the “back” button in his browser. The session cookie is deleted as soon as the user closes the current browser.
BIAN uses the “LinkedIn”- plug-ins of the social network LinkedIn provided by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, United States (“LinkedIn”). The button is marked using the letters “in” or the word “share” on a blue background. If a user visits one of the websites using such a button, the user’s browser directly connects to LinkedIn’s servers. The plug-in and its content are loaded directly from LinkedIn’s servers and included in the website by the user’s browser. For this reason, the provider of the website cannot influence which data LinkedIn connects via the button. If a user that is a LinkedIn member and logged in on the network at the time of clicking on the button, LinkedIn will connect this information with the user’s profile. BIAN endeavors to achieve a level of correctness of the stored personal data of users that corresponds to the current standards. For this purpose, BIAN will take a precautionary measure by allowing individual persons reasonable access to the stored personal data of users in order to check, correct or anonymize (if necessary), block or delete such data. Within the framework of BIAN’s offering, the opportunity also exists for our users, following authentication, to independently inspect and/or modify the data they have transmitted.
9. Rights of the users
Each user is at liberty at all times to object to the processing and use of his personal data for purposes of advertising or the market and opinion research. In particular users can object to the use of their email address for the receipt of information of BIAN at all time without other costs incurred to the users for this purpose than the transmission costs according to the basic tariffs. BIAN will clearly point out their right to objection to its users both when collecting the email address as well as with each use in other information.
Users have a right to information with respect to the data gathered and stored by BIAN. In specific individual cases, BIAN is entitled to give information or obligated to give such information to the competent offices on the basis of statutory provisions.
10.1 Informational right of users
In response to a request by a user, BIAN will at no charge give information concerning all personal data stored by BIAN concerning him. In principle, such information is transmitted in electronic form (via email). Such customer inquiries are to be directed to the address stated at the end of this data protection declaration. If the user takes advantage of this opportunity for the issuance of information via email, the stated email address (both sender and recipient) will not be used for any purpose other than the issuance of information and the documentation thereof.
