This is the Privacy Policy of B.I.A.N. Services GmbH, c/o Schulte Riesenkampff Rechtsanwaltsgesellschaft mbH, An der Hauptwache 7, 60313 Frankfurt am Main, Germany (hereinafter: BIAN).
BIAN respects your right to a sphere of privacy. BIAN would, by means of this Privacy Policy, like to provide the users of the offering with supplemental information concerning the handling of personal data. BIAN will of course treat all personal data that a user transmits in the course of the business relationship in compliance with the German applicable data protection provisions.

2.              Scope of application

This Privacy Policy is applicable to all offerings of BIAN under the domain “www.bian-services .com” (“offering”).

If other offerings of BIAN have a differing Privacy Policy, the differing Privacy Policy published on the respective website or in the respective offering shall apply. The BIAN offering might contain cross-references (“links”) to other websites of third-party providers. By clicking on such links you sometimes leave the websites or offering of BIAN and reach the websites or offerings of third parties, for whose content, compliance with data protection, or data protection declaration BIAN assumes no responsibility. The BIAN Privacy Policy does not apply to such websites or offerings of third parties. 3.              Gathering of data

3.1           Usage data

BIAN’s system automatically records information, namely usage data, during the visit to BIAN’s offering. This might include data such as browser type, browser language, geographical origin, date and type of the visit, access time or the address of the visited pages, the user’s IP address and the domains from which the user is accessing BIAN’s offering.

The IP address is saved only for the period of use and will be deleted or made anonymous afterwards.

We use this data primarily to ensure system security and to optimally adjust our products to the needs of our users.

3.2           Personal data

“Personal data” is understood to refer to individual particulars concerning personal or objective circumstances of a specific or determinable natural person. This is data such as e.g. company name, address, mailing address and telephone number.

BIAN gathers personal data to the extent that they are necessary for the establishment, substantive structure or modification of the contractual relationship between BIAN and the respective user concerning the use of the offering of BIAN or if the user has communicated them in the course of contacting BIAN. In addition, personal data is only processed and used for other purposes if the user has given his advance consent to do so.

With complete execution of the contract the data are being blocked for further use and shall be deleted after expiration of storing periods according to tax and trade law.

3.2.1                        Newsletter

If you wish to subscribe to our newsletter we ask you to provide your email address. Before we send you the newsletter you will receive an email notification with a link. Only by clicking on this link, confirming that you actually wish to receive the newsletter you will be included in our distribution list. This ensures that nobody other than you can use your email address for subscription to a newsletter (so-called double opt in procedure).

You can withdraw your consent for receiving the newsletter at any time by sending a message to us or simply by clicking on the link provided at the bottom of each newsletter.

3.2.2                        Advertising

BIAN likes to contact customers to provide them with information about special offers and news on products and services. If you register on our Website or place an order for our products and services, you will be asked to indicate whether you would like to receive advertising information directly.

3.2.3                        Contractual relationship

BIAN uses personal data of users to the extent necessary for the establishment, performance or ending of the contractual relationship with the respective users. This is the case if, among other things, users wish to utilize the products and services of BIAN via the BIAN offering.

Both the simple transmission of specific personal data by the user (for example, in specific forms for product or service orders), as well as the registration of a user for the use of the BIAN service, might be necessary by way of electronic or other communication as part of the use of the BIAN offering. A user’s registration for the opening of an account on BIAN’s offering generally requires the entry of the company name, address and email address. A password is selected by the user during registration. Upon voluntary confirmation of the registration, the user receives access to BIAN’s offering.

User data can be used within the framework of communication. In this regard as well, BIAN will adhere to its standards as set in this Privacy Policy.

In the event of inquiries by users, BIAN will process personal data for the purpose of answering them. BIAN archives correspondence with users with the goal of improvement of BIAN’s products and services and BIAN’s offering and for its own business purposes.

4.              Transfer of data

BIAN transmits your personal data to third parties only if you have consented to the transfer or if the transfer is necessary for the performance or the invoicing of the services or law enforcement agencies or courts demand information for the purpose of criminal prosecution in accordance with the provisions of the applicable law.

BIAN is also entitled to make user data available to third parties, to which claims of BIAN against users have been assigned, to the extent that making such data available is necessary to the collection of the claim. BIAN will inform the user of the name of the third parties.

If BIAN collaborates with third parties for purposes of the rendering of the services, BIAN will commit them to observe the applicable German data protection provisions and guarantee adequate data protection.

4.1.1                        Payment processing

BIAN is entitled to make user payment data available to an assigned service provider. BIAN cooperates with PAYONE GmbH from Germany. Insofar as users provide credit card data to BIAN for the payment in the real time process, the credit card numbers are used exclusively for the payment processing and no other purposes. BIAN can use the services of a provider for fraud management of the payment process in order to create an increased degree of security against fraud for the benefit of the users and BIAN and to promote the protection of financial information.

4.1.2                        MailChimp

We use the list provider MailChimp to send our newsletters. MailChimp is a product of The Rocket Science Group, LLC, 512 Means Street, Ste 404 Atlanta, GA 30318. When you register for our Newsletter, the data you provide in the registration will be transferred to MailChimp and stored there. MailChimp participates in and has certified its compliance with the EU-U.S. Privacy Shield Framework.

MailChimp provides extensive analysis on how the newsletters are opened and used. These analyses are group-related and are not used by us for individual analysis. MailChimp additionally uses the analysis tool “Google Analytics” and includes it in the Newsletter where appropriate. 5.              Cookies

BIAN uses so-called “cookies.” A cookie contains information that the BIAN offering sends to the user’s browser, which then stores the information on the user’s system. If cookies are used, BIAN’s offering is able to note information about the user and his settings until the user closes the current browser window (so-called “session cookies”) or until the user deactivates or deletes the cookie or the validity of the cookie expires. BIAN uses cookies for statistical purposes as described below.

BIAN uses session cookies when users log in to the BIAN offering. In this case, BIAN’s web server automatically sends a session cookie to the user’s browser. Session cookies are used within the framework of authentication of users. Authorized users are logged when they register for the BIAN service. A session cookie is set for the connection, to indicate that the user has been authenticated. This session cookie contains random data that the server uses to authenticate the browser queries to the server within that session. Cookies contain information about which services within the BIAN service the users have been used, in which country the computer of the user is located and in which language the BIAN service has been used. Additionally, the cookie contains the user ID, a number which is assigned to each user by BIAN. In addition, the session cookie contains a value, by means of which the BIAN software can determine which page is supposed to be displayed when the user clicks the “back” button in his browser. The session cookie is deleted as soon as the user closes the current browser.

6.              LinkedIn

BIAN uses the “LinkedIn”- plug-ins of the social network LinkedIn provided by LinkedIn Corporation, 2029 Stierlin Court, Mountain View, CA 94043, United States (“LinkedIn”). The button is marked using the letters “in” or the word “share” on a blue background. If a user visits one of the websites using such a button, the user’s browser directly connects to LinkedIn’s servers. The plug-in and its content are loaded directly from LinkedIn’s servers and included in the website by the user’s browser. For this reason, the provider of the website cannot influence which data LinkedIn connects via the button. If a user that is a LinkedIn member and logged in on the network at the time of clicking on the button, LinkedIn will connect this information with the user’s profile. 7.              Google Analytics

This website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the website will be transmitted to and stored by Google on servers in the United States. In case IP-anonymisation is activated on this website, your IP address will be truncated within the area of Member States of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases the whole IP address will be first transferred to a Google server in the USA and truncated there. The IP-anonymisation is active on this website. 8.              Data integrity and security

BIAN endeavors to achieve a level of correctness of the stored personal data of users that corresponds to the current standards. For this purpose, BIAN will take a precautionary measure by allowing individual persons reasonable access to the stored personal data of users in order to check, correct or anonymize (if necessary), block or delete such data. Within the framework of BIAN’s offering, the opportunity also exists for our users, following authentication, to independently inspect and/or modify the data they have transmitted.

BIAN takes a number of commercially reasonable administrative, technical, personnel and physical steps to safeguard information in their possession from loss, theft and unauthorized use, disclosure or modification. However, no method of transmitting or storing electronic data is ever completely secure, and therefore BIAN cannot warrant or guarantee that such information will never be accessed, used or released in a manner that is inconsistent with this Privacy Policy. 9.              Rights of the users

Each user has a right to the correction, blocking and deletion of his personal data in accordance with the statutory provisions. If the user does not undertake any amendment or deletion himself, BIAN is available at the address stated at the end of this Privacy Policy and is happy to receive corresponding applications. BIAN will appropriately amend or, as the case may be, delete personal data of users of BIAN’s offering as quickly as possible. BIAN points out that, due to technical and organizational conditions, it is possible that, even after the request for amendment or deletion, some measures will still be carried out that have already begun, but have not yet been completely executed, after users notified BIAN of the request for deletion. BIAN likewise points out, however, that deletion of user data is only possible if it is not precluded by legal provisions, particularly with respect to data for billing and/or bookkeeping purposes.

Each user is at liberty at all times to object to the processing and use of his personal data for purposes of advertising or the market and opinion research. 10.           Information

Users have a right to information with respect to the data gathered and stored by BIAN. In specific individual cases, BIAN is entitled to give information or obligated to give such information to the competent offices on the basis of statutory provisions.

10.1        Informational right of users

In response to a request by a user, BIAN will at no charge give information concerning all personal data stored by BIAN concerning him. In principle, such information is transmitted in electronic form (via email). Such customer inquiries are to be directed to the address stated at the end of this data protection declaration. If the user takes advantage of this opportunity for the issuance of information via email, the stated email address (both sender and recipient) will not be used for any purpose other than the issuance of information and the documentation thereof.

10.2        Informational right of third parties

In individual cases, BIAN can be entitled to inform third parties concerning personal data of the users of offerings of BIAN. BIAN reserves the use of its right to give information in individual cases following detailed review and careful consideration. If BIAN is legally obligated to forward its data to local, state, national or international agencies, BIAN will comply with such obligation. In addition, BIAN will disclose data to third parties if applicable statutes and regulations so require. Moreover, BIAN can disclose information in order to review or prevent illegal activities or a suspicion of fraud or to initiate appropriate counter-measures or in order to enforce or apply the contracts of BIAN.

11.           Amendment of the Privacy Policy

BIAN reserves the right to amend this Privacy Policy at any time, but BIAN will always observe the applicable statutes concerning data protection. BIAN recommends that users review the current Privacy Policy at the time of each visit to the BIAN offering. BIAN will naturally inform the users in advance if it wishes to use the users’ personal data to a greater extent than set forth in this data protection declaration.
